and steve hariggan is in virginia beach, virginia, where they are awaiting earl's heavy rains and high winds. steve, what's it like so far? >> reporter: none of that rain hitting yet. the winds have gotten slightly stronger with gusts up to 30 or 40 miles per hour. they expect the eye of the storm to pass 100 miles offshore here in virginia beach. so they don't expect too much physical damage. 200 national guard troops have been moved to the coastline in case they are necessary and shelters have been set up for as many as 20,000 people. that doesn't look like it's going to happen so far. throughout the day, we saw people boarding up their houses with plywood or hard plastic. but a lot more cureiosity. even righted now, we have a number of people walking along the boardwalk or the beach. gusts of winds, but not a sense of impending peril here. some real concerns about the economic potential that this storm could bring, some major events scheduled for this weekend, a large concert and a large half marathon. so travelers expected here. they are going to have difficulty traveling thro

, rich reichmuth is in the weather center and steve hariggan is in virginia beach, virginia, where they are awaiting earl's heavy rains and high winds. steve, what does it look like now? we saw a wind situation. have you seen any more rain? >> reporter: no rain yet. you were talking about how the storm has developed over the past few days. we were down a couple of days ago in the u.s. virgin islands where we saw this as a much more powerful storm than we are feeling it here. in the virgin islands we were there and it was really strong enough to take roof its off of buildings and knock down trees, quite a bit of structural damage in the north eastern caribbean. real concern for life and limb. here in virginia, we are seeing a very different story because the storms moved so slowly, about 15 or 18 miles per hour, you can really leap-frog and keep up with it. >> it depends on travel and whether the flights go in on time. virginia beach was expecting a huge tourist weekend, both the american music festival with reo speed wagon set to play here as well as the rock and roll half marathon

health insurance policy or pay a penalty? >> greta: in the state of virginia they have a different statute which says that you can require people of virginia to buy health care insurance. they got past that standing. that of any value to you here? any advisory value or it is different? >> it's a little different here. advisory value because one of the key issues is whether we have a statute or not, does the state have a right to have such a statute pre-- preemed by the federal government? i will contend that in fact the state's sovereignty is at question. we have the trite pass a similar law to what they did in virginia. the government has said we are going to preempt this whole area. the other thing that is important the interconnectivity is the law. -- of this whole law. >> greta: usually one section gets knocked out the rest of the statute stands. mr. cuccinelli told me in virginia he has found no severability clause. >> even the government concedes this requirement that you have to buy a policy is at the heart of the law if it goes the entire process, the law doesn't work. we f

. right now, in virginia beach, virginia they're watching and waiting for earl. but first, checking in live from the fox news extreme weather center. what can you tell us about where this storm is now? >> this advisory just came in minutes ago. still 150 miles now south-southeast here of cape hat tras. weakened a little bit now to 105 miles per hour, sustained down from 140 miles per hour where we were today. and it continues to make a little bit more of an easterly jog here that. is certainly good news for folks across the outer banks. however, some of the rain is moving on shore now. there are winds around 50-60 miles per hour. and as this band right here, is the last image right there. that is where struggle was winds are. we're likely up to 80 or 90 mimp going to get closer so i think around 2:00, 3:00 in the morning we're going to potentially see the worst of this. hurricane warnings in effect across outer banks. and then, we still have a hurricane warning in affect across areas of massachusetts. why in just a moment. we're going deal with three to five inches of rain not as ba

right. breaking news overnight because this is happening in virginia. a woman has been executed for the first time in almost 100 years. theresa lewis was convicted in 2003 of plotting the murder of her husband and stepson. she apparently wanted their insurance money. she died by lethal injection. lewis' final words were for her stepdaughter. >> miss lewis did make a last statement. she said i just want kathy to know i love her. and i'm very sorry. >> protesters were outside the prison arguing that lewis was treated unfairly, apparently he was very close to the i.q. line where you're not supposed to get executed. police trying to figure out who killed a nicaraguan diplomat in his apartment in the bronx here in new york. he was found on the floor. his throat had been slashed. this just hours before he was scheduled to attend the u.n. general assembly. witnesses say there was a fight in the apartment the night before the murder. police believe he probably knew his killer. >> people filling sandbags now all across southern minnesota and western wisconsin. that's going to happen all day

the storm. up eastern north carolina up towards virginia beach and the chesapeake bay. d.c., you're going to get a few raindrops within the next several hours but all in all the center of this storm is going to remain offshore which is the best case scenario we could have asked for. still see 3 to 4, isolated 5 inches of rain across eastern north carolina and a couple inches as we ride up the coast. certainly see tropical storm force winds but kind of like a nor'easter and the northeast is accustoms to nor'easters. thank goodness not a direct hit but we're going to monitor it as it continues to move. we'll see a lot of rain, especially the outer banks, cape cod and the islands are going to take a hit as well. >> are we out of the woods now far hurricane season? >> oh, gosh, no. >> november is the end of it. >> we've storms rolling off the coast of africa. i'll show you all the features out there in the atlantic brewing. >> november 30th the -- >> the peak middle of september. >> how do you prepare for a storm like earl and protect your family and house and pets and everything else.

issued a hurricane warning for much of the north carolina coast. and hurricane watches from virginia to delaware. correspondent jonathan serrie is live in hill devil hills, north carolina, with an update. >> reporter: you can see the red flags that the lifeguards have been installing on the beach. it's been a beautiful sunny day here, they are worried about the heavier than usual surf in the atlantic and potentially riptides. earlier today, the lifeguards had to go out and rescue a surfer who could not bat the rip tides. they got him to shore safely. as you look at some of the cottages along the beaches, not seeing any of the boarding up that you normally would, if they were anticipating a direct hit from the hurricane. as you look at the path of the hurricane, the forecasters believe the eye of the storm will stay out to sea. nevertheless, the category four hurricane is a particularly strong storm. and so they are anticipating at least tropical storm force winds where i'm standing right now. potentially hurricane force winds. so many residents and visitors not wanting to take any chanc
